POLICY REGARDING DISCONTINUANCE AS A METHOD OF COMPLIANCE WITH SRBC REGULATION 803.42 - CONSUMPTIVE USE OF WATER

It shall be the policy of the Susquehanna River Basin Commission to regard an applicant's choice of discontinuance during periods of low flow as its compliance option for the SRBC Consumptive Use Regulation 803.42 (18 CFR §803.42) as constituting a complete discontinuance of the applicant's consumptive use. Applicants will not be permitted to simply reduce their consumptive use to a maximum of 20,000 gallons per day (gpd). The 20,000 gpd threshold is not intended to be a threshold for discontinuance of a consumptive use, but rather a threshold for when consumptive uses need to be regulated by the Commission. Projects already engaged in a partial discontinuance mode under previously approved dockets shall be advised of this change in policy and shall be given a period of one year to adopt this new procedure or to seek a new method of compliance.
