POLICY ON THE PROCESSING OF APPLICATIONS FOR PROJECTS THAT HAVE BEEN DISAPPROVED BY A SIGNATORY PARTY OR A POLITICAL SUBDIVISION THEREOF

The review of any application for a project pursuant to Commission Regulation 18 CFR §803.26 shall be suspended if such project is likewise subject to the lawful jurisdiction of a signatory party or any political subdivision thereof and such signatory party or political subdivision has disapproved or denied the same. Where such disapproval or denial is reversed on appeal, such reversal is final, and the project sponsor provides the Commission with a certified copy of such decision, the Commission shall resume its review of the application as provided under the said regulation.

Where an application has been suspended hereunder for a period greater than three years, the Commission may terminate its review and shall notify the project sponsor of such termination. To reactivate the closed docket, the project sponsor shall reapply, provide evidence of its receipt of all necessary governmental approvals, and may be required to submit new or updated evaluations at the discretion of the Commission.
